泰国劳动就业法规及外国人在当地工作规定（二）

泰国位于东盟中心位置，区位优势明显，社会总体较为稳定，政策透明度和贸易自由化程度较高，营商环境开放包容，是东盟第二大经济体。泰国商品在东盟国家享受零关税待遇，对周边国家具有较强辐射能力。在中泰两国政治互信不断加深、中国—东盟自贸区建成并不断深化，以及“一带一路”倡议全方位推进的大背景下，两国经贸合作务实发展、成果丰硕。据中国海关统计，2019年中泰贸易总额917.5亿美元，中国连续7年成为泰国第一大贸易伙伴；中国对泰投资总额9亿美元，历史上首次超过日本，成为泰国最大外资来源国。2020年，受新冠肺炎疫情影响，全球经济下行，中泰贸易总额仍逆势上涨7.5%达到986.3亿美元，中国连续第8年成为泰国第一大贸易伙伴；中国对泰投资8.2亿美元，位列泰国第二大投资外资来源国。中国企业在泰国投资质量稳步提升，经济影响与日俱增，越来越多的中国大企业在泰投资建厂，一批批大型项目相继投产，疫情下生产、经营进展平稳。中泰之间的投资合作已逐步形成多层次、多渠道、全方位的合作格局。

泰国劳动就业法规及外国人在当地工作规定（一）
泰国目前实施的《劳动保护法》（Labour Protection Act）于1998年制定。该法明确了雇主和雇员的权利及义务，建立了关于一般劳动、雇用女工和童工、工资报酬、解除雇佣关系和雇员救济基金等方面的最低标准。同时，《劳动保护法》也赋予了政府干预管理的权利以确保雇主和雇员双方关系的公平、健康发展。此外，相关立法还有《劳动关系法》（Labor Relation Act）（1975年）、《关于设立劳动法庭和劳动法庭程序的法案》（Act on Establishment of Labor Courts and Labor Courts Procedures）（1979年）、《社会保障法》（Social Security Act）（1990年）和《工人补偿金法》（Workmen’s CompensationAct）（1994年）等。

外国人在当地工作的规定
 ✔ 【法律依据】2017年颁布的《外籍人工作管理法》（2018年修订版）是目前泰国政府管理外籍人在泰国工作的基本法则。2011年公布的《外籍人工作申请批准规定》（2017年第2次修订版）和2020年4月最新公布的《外籍人从业工种限制》是泰国官方受理、审批外籍人在泰工作的主要依据。

泰国劳工部就业厅是外籍人在泰国工作许可的归口管理部门，下属外籍人工作许可证管理局直接管理外籍人在泰国工作许可申请的受理与审批，实行中央、地方两级管理体制。此外，劳工部外籍劳工监察局与泰国警察总署下属移民局、旅游警察局共同协调管理非法入境劳动管理；劳工部劳动稽查管理局负责受理公众对外籍人非法打工的申诉和举报，并进行调查取证和最终的处理。

✔ 【就业规定】

所有在泰国工作的外国人都必须先获得泰国劳工部颁发的工作许可证，没有工作许可证的外国人禁止在泰国从事任何形式工作。申请工作许可的外国人必须是根据移民法规定，允许在泰国合法居住或持非移民签证进入泰国，持旅游或过境的签证外国人不允许申请。

✔ 【办理时限】

截至目前，泰国官方尚未授权任何中介机构从事代办外籍劳务工作许可业务。办理工作许可证的时间视工种而定，一般不超过15个工作日。享受当地投资促进优惠或其他政策的企业，将在收到申请之日起7天内为其外籍雇员办理工作许可，并允许其在此办理期间工作。对临时入境从事紧急或专业工作的外籍人，如不超过15天可免办工作许可证，但需书面向相关官员报告。

✔ 【持证要求】

（1）有效期限为1-2年（视该企业情况），到期前须及时提出续延申请；

（2）持有者须随身携带证件；

（3）在劳工管理部门官员到业主住地履行公务查验证件时，雇主要予以适当协助；

（4）不能异地使用（在不变更雇主的情况下），在申请工作场所时要将总公司、分公司场所分别加以注明。分公司以总公司名义申请时，要在分公司所在地申请。

✔ 【外籍劳务的规定】

泰国政府对外国人在泰国投资、经商、从教等申请工作许可基本持积极态度，鼓励在泰国外国人通过合法程序申请工作许可。2020年4月最新公布的《外籍人从业工种限制》虽对部分工种有条件地放开，但仍严格限制外籍人从事以下27类工种：

（1）木雕工作；

（2）汽车驾驶或其他非机动交通工具的驾驶，除国家航班的驾驶和叉车驾驶；

（3）拍卖；

（4）珠宝钻石加工；

（5）美容美发；

（6）手工织布；

（7）织席或使用藤麻草竹子制作器具的工作；

（8）手工造纸；

（9）漆器制作；

（10）泰国乐器制作；

（11）乌银镶嵌器制作；

（12）金、银铜饰品器具的制作；

（13）石器制作；

（14）泰国玩偶制作；

（15）僧钵制作；

（16）手工泰丝制作；

（17）佛像制作；

（18）纸伞或布伞制作；

（19）经理人或者代理人工作，国际投资贸易代理人除外；

（20）泰式按摩；

（21）手工卷烟；

（22）导游和旅行社工作；

（23）个体小商贩；

（24）泰文字符手工印刷；

（25）手工抽丝；

（26）文书工作或秘书；

（27）法律服务或法律程序，仲裁、协助工作或代理仲裁程序除外。
